Terms of Business
These Terms of Business set out the basis on which we provide services to you and outline the responsibilities of both our firm and you. Please read this document carefully.

1 Authorisation

Future Proof Finance Ltd is authorised by the Central Bank of Ireland as:

  • A Mortgage Intermediary under the Consumer Credit Act 1995
  • An Insurance Intermediary under the EU (Insurance Distribution) Regulations
  • An Investment Intermediary under the Investment Intermediaries Act 1995

2 Our Services

TrustPoint Finance provides advice and intermediary services in relation to:

  • Residential mortgages
  • Investment property mortgages
  • Insurance protection policies
  • Pension products including PRSAs
  • Investment products including collective investment schemes and bonds

We act on a fair analysis basis, considering a large number of product providers to recommend the most suitable product for your needs.

3 Consumer Protection Code

We are subject to the Consumer Protection Code issued by the Central Bank of Ireland, designed to protect consumers and ensure firms act in the best interests of clients.

4 Client Classification

Clients are generally treated as Retail Clients, which affords the highest level of regulatory protection under applicable financial services legislation.

5 Product Suitability

All recommendations are based on information provided by you. It is important that the information you provide is accurate and complete. You must inform us if your circumstances change.

A Statement of Suitability will be provided explaining the basis of our recommendation.

6 Duty of Disclosure (Insurance)

⚠️ Insurance contracts require full disclosure of all material facts. Failure to disclose relevant information may result in claims being declined or policies cancelled.

7 Conflicts of Interest

We aim to avoid conflicts of interest when providing services. Where a conflict cannot be avoided, we will disclose this to you before providing advice. Any referral relationships will also be disclosed where relevant.

8 Complaints Procedure

We will acknowledge complaints within five business days and investigate fully. Contact:

9 Investor Compensation Scheme

Future Proof Finance Ltd is a member of the Investor Compensation Scheme under the Investor Compensation Act 1998.

💰 Maximum compensation: 90% of the loss, subject to a maximum of €20,000.

10 Professional Indemnity Insurance

Future Proof Finance Ltd maintains Professional Indemnity Insurance in accordance with Central Bank requirements.

11 Sustainable Finance Disclosure (SFDR)

When providing investment advice, we may consider sustainability risks — environmental, social or governance events which may negatively impact investment value. Further information is available on request.

12 Claims

Claims should normally be made directly to the insurer. If you experience difficulty, we will assist you in submitting the claim.

13 Default of Payment

We reserve the right to recover any outstanding fees owed for services provided. Product providers may withdraw benefits or cover if premiums are not paid.

14 Fees & Remuneration

TrustPoint Finance may be remunerated by a combination of fees and commissions from product providers. All fees will be agreed in writing before services are provided.

Mortgage — Advisory / Processing Fee €300 – €700
Investment — Single Premium 0% – 5%
Investment — Regular Premium 0% – 25%
Investment Advice (Professional Fee) €500 – €6,000
Life Insurance & Protection 20% – 225% of annual premium
Pension — Single Premium 0% – 5.5%
Pension — Regular Contributions 0% – 25%
Claims Assistance Up to 15% of successful claim
⚠️ Clawback: If commission is clawed back by a provider due to early cancellation, we reserve the right to recover the clawed back amount.

15 Anti-Money Laundering & Identity Verification

Under the Criminal Justice (Money Laundering and Terrorist Financing) Acts, we are required to verify client identity. We may request:

  • Passport or driving licence
  • Proof of address (utility bill or bank statement)
  • PPS number confirmation
  • Source of funds information

16 Client Assets

TrustPoint Finance does not hold client investments or assets. All products arranged are held directly with the relevant product provider in the client's name.

17 Cancellation Rights

Clients may have a right to cancel certain financial products within a cooling-off period. Full details will be provided in the product documentation issued by the relevant provider.
